Assaults at school lead to big rise in teacher compensation claims, union says

The Educational Institute of Scotland (EIS) has reported a substantial increase in compensation claims from teachers due to rising violence in schools. According to EIS figures, compensation payouts surged from £295,597 in 2022 to £541,499 in 2023. This increase is mainly attributed to incidents of assault on teachers, with five such claims recorded. Notably, a single settlement reached £180,000 after a teacher suffered a serious injury in a school assault.

EIS General Secretary Andrea Bradley expressed deep concern over the growing trend of violent incidents, emphasizing the need for urgent action from both local authorities and the Scottish Government to ensure a safe working environment for teachers. Bradley stated, "No one deserves to suffer injury or assault in their workplace," highlighting the legal duty of care that employers, including local authorities, hold to maintain a secure environment for school staff.

In a call for additional resources, including increased staffing, the EIS aims to support pupils exhibiting distressed or violent behavior. Bradley underscored the urgency, stating, "Local authorities and the Scottish Government must work together to deliver safer schools so that school staff can work without fear of physical harm, and all young people can learn in a safe, secure, and nurturing environment."

Responding to the concerns, a Scottish Government spokesperson acknowledged the issue, affirming that Scotland's schools should be safe learning environments for all. The spokesperson revealed plans for a National Action Plan aimed at addressing incidents of disruptive behavior and emphasized collaboration with trade union partners in its development. The government also highlighted the statutory responsibility of local authorities to protect pupils and teachers, with potential enforcement actions by the Health and Safety Executive for non-compliance with health and safety legislation.
